AmberMap Terms of Service

§1. General Provisions

The website available at ambermap.com (hereinafter: "Service") is operated by: Konrad Żelazny, NIP: 6762506379, address: Glanów 106B, 32-353 Trzyciąż, registered in the Central Register of Economic Activity (CEIDG), email: contact@ambermap.com (hereinafter: "Administrator").

These Terms of Service define the rules for using the Service, including account registration and subscription purchase.

Every User is required to read the Terms of Service before using the Service.

§2. Services Provided Electronically

The Administrator provides the following services through the Service:

  1. User Account management (free service).
  2. Access to the interactive map and information portal.
  3. Premium Subscription service (paid), including notifications about predicted amber deposits.

The User cannot add their own public content to the Service.

§3. Contract and Payments

The Subscription contract is concluded at the time of payment by the User.

Subscription payments are processed by Paddle.com Market Limited (Ireland), which acts as our authorized reseller and Merchant of Record. Paddle handles all customer service inquiries, payment processing, returns, and tax compliance (including VAT). Invoices are issued by Paddle (not by the Administrator). Prices in the Service are displayed in PLN; Paddle may convert them to local currencies at its exchange rate during checkout.

The Subscription is activated immediately after the Administrator receives payment confirmation from the operator.

Prices listed in the Service are gross prices.

§4. Right of Withdrawal and Refunds

A User who is a Consumer has the statutory right to withdraw from a distance contract within 14 days of its conclusion without giving a reason. To exercise this right, contact us at contact@ambermap.com or request a refund through Paddle's Customer Portal (linked in the purchase confirmation email).

30-day refund window via Paddle

Our payment processor Paddle offers a 30-day goodwill refund window — exceeding the statutory minimum. Refund requests submitted within this window are typically approved without dispute, regardless of reason.

Statutory rights regarding the non-conformity of digital services (Polish Consumer Rights Act, Chapter 5b, Articles 43k–43r — implementing EU Directive 2019/770) remain fully preserved and are not limited by this section.

§5. Complaints

The User has the right to file a complaint at: contact@ambermap.com

The Administrator will process the complaint without undue delay and no later than 14 calendar days from receipt. Failure to respond within this period is deemed acceptance of the complaint, in accordance with art. 43m of the Polish Consumer Rights Act.

§6. Definitions

For the purposes of these Terms of Service:

  • Consumer means a natural person concluding a legal transaction with the Administrator that is not directly related to their business or professional activity, within the meaning of art. 22¹ of the Polish Civil Code.
  • References to Consumer in these Terms also apply, to the extent provided by art. 38a of the Polish Consumer Rights Act, to a natural person concluding a contract directly related to their business activity but where the contract is not predominantly of a professional nature for that person.
  • Service means the AmberMap web application available at ambermap.com.
  • Administrator means Konrad Żelazny, NIP 6762506379, address Glanów 106B, 32-353 Trzyciąż.
  • Premium means the paid subscription tier of the Service granting extended access to forecasts and additional features.
  • Subscription means a paid agreement granting the User access to Premium for a defined Subscription Period, automatically renewing unless cancelled.
  • Subscription Period means the billing cycle of the Subscription (weekly, monthly, or annual).

§7. Auto-Renewal and Cancellation

The Subscription is billed in advance for each Subscription Period and automatically renews at the end of each period for the same duration unless cancelled before the renewal date.

The User may cancel the Subscription at any time via the Settings page in the Service or through the Paddle Customer Portal (linked in every billing email). Cancellation is no more difficult than the subscription process, in accordance with art. 11a of the Consumer Rights Act.

Upon cancellation, the User retains access to Premium until the end of the current paid Subscription Period. No further charges will be made; no proration is provided for unused portions of the period.

The Administrator will provide at least 30 days' advance notice of any price change affecting the User's Subscription. The User may cancel before the new price takes effect, in which case no further charges apply at the previous rate beyond the current period.

§8. Conformity of the Digital Service and Updates

The Administrator undertakes to provide the Service in conformity with the description, the agreed features, and the reasonable expectations of the User, in accordance with Chapter 5b (art. 43k–43r) of the Polish Consumer Rights Act and EU Directive 2019/770.

If the Service is not in conformity with the contract, the User who is a Consumer may demand performance, request a price reduction proportional to the non-conformity, or terminate the contract with a refund where the non-conformity is material.

For non-conformities that become apparent within twelve (12) months of the Service being made available, it is presumed that the non-conformity existed at the time of supply. The User must report the non-conformity to the Administrator within a reasonable time.

The Administrator will provide updates necessary to maintain the Service in conformity with the contract, including security and functional updates, throughout the Subscription Period.

§9. Liability and Disclaimers

Amber forecasts provided by the Service are based on physical models and meteorological data. They are informational in nature and do not constitute a guarantee of finding amber on any beach.

The Administrator is not liable for travel costs, fuel, time invested, weather conditions encountered, or other expenses incurred by the User in reliance on the forecasts.

The User is solely responsible for personal safety on beaches and at sea. Safety warnings displayed in the Service (ice, high waves, inaccessibility) are advisory; the User must always assess local conditions independently and obey applicable signage and authority instructions.

The Administrator makes commercially reasonable efforts to maintain Service availability but does not warrant uninterrupted operation. For prolonged unavailability, the User retains the right to a pro-rata refund as set out in our Refund Policy; the Administrator's liability for downtime is limited to that remedy.

The above limitations do not exclude or limit: (a) the Administrator's liability for damage caused intentionally or by gross negligence, or for harm to life or health of the User; (b) the Consumer's statutory non-conformity rights under Chapter 5b (art. 43k–43r) of the Polish Consumer Rights Act; (c) any other liability that cannot be excluded under Polish or EU law.

§10. Acceptable Use and Intellectual Property

All content of the Service, including the AmberMap brand, the Amber Forecasting Engine (AFE) methodology and physical models, maps, forecasts, illustrations, and documentation, is the exclusive property of the Administrator and is protected by copyright and intellectual property law.

The User is granted a personal, non-transferable, non-exclusive license to use the Service for personal, non-commercial purposes for the duration of their account or Subscription.

The User shall not: scrape, crawl, or otherwise extract Service data by automated means; resell, sublicense, or commercially redistribute access to Premium features; share account credentials with third parties; or attempt to reverse-engineer the AFE methodology or physical models.

Each User account is personal. Multiple individuals using a single account is grounds for termination of the Subscription without refund.

§11. Termination by Administrator

The Administrator may terminate or suspend the Subscription for cause in the event of: non-payment, material breach of these Terms (including unauthorized account sharing or scraping), fraudulent activity, or abuse of the Service.

For non-cause termination (e.g. discontinuation of the Service), the Administrator will provide at least 30 days' advance notice and refund the User pro-rata for the unused portion of the paid Subscription Period.

For termination for cause due to a material breach by the User, no refund is owed, and the User remains liable for any outstanding charges. Statutory consumer rights remain unaffected.

§12. Modifications to These Terms

The Administrator may modify these Terms of Service from time to time. Non-material changes (e.g. clarifications, corrections, updated provider names) take effect upon publication.

Material changes affecting paid features, pricing, or User rights will be communicated by email to active Subscribers at least 30 days before they take effect.

If the User does not accept material changes, they may cancel the Subscription before the new Terms take effect, in which case access continues until the end of the current paid period and no further charges apply.

§13. Out-of-Court Dispute Resolution

The User who is a Consumer has the right to use out-of-court mechanisms for handling complaints and pursuing claims.

The Online Dispute Resolution (ODR) platform provided by the European Commission is available at: https://ec.europa.eu/consumers/odr.

Polish Consumers may also turn to: permanent consumer arbitration courts at Voivodeship Inspectorates of Trade Inspection (Stałe Polubowne Sądy Konsumenckie), the Voivodeship Inspector of Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej), and county or municipal consumer ombudsmen (Powiatowy/Miejski Rzecznik Konsumentów).

Use of these mechanisms is voluntary; the Administrator may, but is not obligated to, participate in such proceedings.

§14. Functionality, Interoperability, and Compatibility

The Service is a web application accessible through modern web browsers (Google Chrome, Mozilla Firefox, Safari, Microsoft Edge — last two major versions). No local installation is required.

An active internet connection is required to use the Service. The Service operates on both desktop and mobile browsers.

Premium notification features (e.g. amber alerts) require a valid email address registered with the User account.

§15. Governing Law, Jurisdiction, and Language

These Terms of Service are governed by Polish law.

For disputes with a User who is a Consumer residing in another EU Member State, the User retains all mandatory consumer protections of their country of residence (Regulation Rome I, art. 6); these protections cannot be waived or limited by these Terms.

Disputes with Users who are not Consumers are subject to the exclusive jurisdiction of the court competent for the Administrator's place of business in Poland.

The Polish-language version of these Terms is the reference text. For Consumers, where the Service was presented in a language other than Polish at the time of contract conclusion, the language version actually shown to the Consumer governs that Consumer's contract; the Polish version applies in any other case and resolves matters not addressed by a translated version.

§16. Account Requirements

Use of the Service is restricted to natural persons aged 16 years or older, in accordance with art. 8 of the GDPR as implemented in Polish law. Accounts created by persons under 16 will be terminated.

Each individual may hold only one account. Creating multiple accounts to circumvent free-tier limits is grounds for termination.

The User is responsible for the accuracy of registration data and for maintaining the confidentiality of account credentials.
